A. Definition of Terms
In this document, "Ludimusic" refers to the trademark of the company Ludimax.com, Trading, Lda, headquartered at Rua do Porto da Pedra, 11, 2460-898 Turquel, Portugal, registered at the Lisbon Commercial Registry Office (NIPC 505372533). For communication purposes, Ludimusic can be contacted via the email servicoclientes@ludimusic.com. It operates in the trade of goods and the provision of services and is governed by the rules and conditions described in the following chapters, in accordance with the legal provisions and practices accepted in the general trade of goods and services in the Portuguese national market, the European Union, and third countries.
These Terms and Conditions apply to visitors of the website www.ludimusic.com (hereinafter "Ludimusic Site"), as well as to all commercial transactions carried out by the customer for products and services offered by Ludimusic, as referenced in Decree-Law No. 24/2014 of February 14.
To ensure a clear understanding of the terms and conditions established in this document, it is important to clarify the meaning of some key terms used throughout the text. The term "Ludimusic Site" refers to the website www.ludimusic.com and all its subdomains, where customers can purchase products and services offered by Ludimusic. "User" refers to any person who accesses or uses the Site. "Customer" is the term used to refer to a user who purchases products or services on the Site. An "Account" is the personal area created by a user on the Ludimusic Site, where personal information, order history, and communication preferences, among other things, can be stored. Creating an account is optional but required to complete a purchase and access additional features. "Content" includes all elements present on the Site, including but not limited to text, images, videos, logos, registered trademarks, design, information about products and services, and any other information or material made available through the Site. The content is the property of Ludimusic and/or its partners and suppliers and is protected by applicable intellectual property laws.
In the event of a conflict between one or more commercial conditions described in this document, the non-compliant condition(s) will not apply to the purchase in question, without prejudice to the remaining conditions. Ludimusic undertakes to comply with the legal provisions and practices accepted in the general trade of goods and services, in accordance with applicable laws and regulations.
B. Acceptance of Terms and Conditions
By purchasing goods or contracting services in Ludimusic-branded stores, the Customer accepts the rules and conditions described in this document. These commercial conditions apply to all acts of purchase of goods or provision of services related to Ludimusic.
C. Changes to the Terms and Conditions
Ludimusic reserves the right to change or update these terms and conditions at any time, without prior notice. Changes will take effect as soon as they are published in this document. The Customer is responsible for periodically reviewing the updated terms and conditions. By continuing to use Ludimusic's services after the changes are published, the Customer accepts the new conditions.
D. Language Availability
The Ludimusic Site may be available in multiple languages to facilitate access for international users. However, in the event of a discrepancy or conflict between translated versions and the Portuguese version, the Portuguese text shall prevail as the only legally binding version. Ludimusic does not guarantee the accuracy or completeness of translations, and it is recommended to consult the Portuguese version for clarification on rights and obligations.
A. Eligibility
To create an account on the Ludimusic Site, Users must meet the following criteria:
- Minimum age: The user must be at least 18 years old or have proper authorization from parents or legal guardians to create an account and carry out transactions on the Ludimusic Site.
- Legal capacity: By creating an account, the user declares to have legal capacity to enter into binding contracts, which means not being subject to any legal restriction or limitation of capacity that prevents the conclusion of contracts.
- Suspended accounts: If the user has had an account suspended or terminated on the Ludimusic Site due to violations of the terms and conditions, site policies, or applicable legislation, the creation of a new account may be denied at the discretion of the Ludimusic Site.
B. Account Security
Users are responsible for ensuring the security and confidentiality of their account access password. It is recommended to choose a strong password, combining uppercase and lowercase letters, numbers, and symbols, and to avoid using information easily associated with them, such as birthdays or names of family members. It is important not to share the password with third parties and to update it regularly.
If unauthorized access or fraudulent activities related to the account are suspected, the User must immediately notify the Ludimusic Site. This notification allows the Ludimusic Site team to take appropriate measures to protect the account and investigate possible security breaches.
The User is also responsible for all activities carried out through their account. The Ludimusic Site is not responsible for any loss or damage resulting from the user's failure to comply with this obligation or from misuse of their account by third parties.
C. Account Termination
i. Violation of Terms and Conditions
The Ludimusic Site reserves the right to terminate or suspend a user's account in various situations. If the user violates the terms and conditions set out in this document, the policies of the Ludimusic Site or applicable legislation, the account may be terminated.
ii. Fraudulent Activities
The same applies if fraudulent activities related to the user's account are detected, such as the use or suspected use of stolen payment information or the violation of intellectual property; the Ludimusic Site may terminate or suspend the user's account in order to protect its interests and those of other users.
iii. Inactivity
The Ludimusic Site may terminate accounts that remain inactive for a prolonged period, as defined in the site's policies. This measure aims to optimize resource management and ensure the security of users' information.
iv. Customer Request
The user may request the termination of their account at any time by contacting the Ludimusic Site's customer support team. After the request, the site team will take the necessary steps to close the account and remove the user's personal data, in accordance with privacy policies and applicable laws.
v. Legal Reasons
In some cases, the Ludimusic Site may be required to terminate or suspend a user's account for legal reasons, such as court orders, requests from competent authorities, or compliance with legal obligations.
In all account termination situations, the Ludimusic Site will comply with applicable laws and regulations and cooperate with authorities as necessary. The user is responsible for fulfilling all outstanding obligations before the effective closure of the account.
All information made available online about the marketed items, namely, technical characteristics, usage, combination between them, or others, was compiled by Ludimusic based on data received from the suppliers themselves.
Under no circumstances is the use of the marketed items advised without following all procedures and instructions contained in the installation and user manuals provided by the manufacturers – this information may be available through manuals included in the product packaging, on the brand's websites, or on the Ludimusic Site.
Therefore, Ludimusic is not responsible for the incorrect use of the marketed items, this being the total responsibility of the customer.
A. Product Description
The product description on the Ludimusic Site includes detailed information to help users make informed decisions about their purchases. The descriptions contain the following elements:
i. Product Name – The product name is clearly indicated, making it easier to identify the item and allowing users to quickly find the products they are looking for.
ii. Images and Videos – The Ludimusic Site provides images and, when available, high-quality videos that accurately represent the product. These visual resources help users get a more concrete idea of the item, facilitating the purchase decision.
iii. Features, Specifications and Others – The descriptions include detailed product features and specifications such as dimensions, weight, color, materials used and functionalities, when provided by the brands. In addition, other relevant information, such as compatibility or system requirements, may be provided as applicable.
iv. Brand – The product's brand is clearly indicated, allowing users to identify manufacturers and make choices based on their preferences or loyalty to certain brands.
v. Manuals – When available, user manuals or assembly instructions are provided, either in physical form with the product or as digital documents available for download on the Ludimusic Site. These manuals help users better understand the operation and maintenance of the purchased products.
B. Prices
The prices and availability of the products on the Ludimusic Site are presented clearly and transparently, addressing the following points:
i. Currency – Product prices are shown in euros (EUR), the official currency of Portugal. The site also offers an indicative view of the price in other currencies; however, this value is only an estimate to help the customer evaluate the final price. Even if the customer chooses a payment method that supports another currency, the final amount to be paid will always be calculated based on the EUR exchange rate.
ii. Price Changes – The Ludimusic Site reserves the right to change the sale prices of products available in all Ludimusic brand stores, whether physical or online, without any prior notice. However, orders already placed will be honored based on the prices in effect at the time of purchase.
iii. Errors – Although the Ludimusic Site takes all measures to ensure the accuracy of the information presented, unintentional errors may occur, such as incorrect prices or outdated stock information. The Ludimusic Site reserves the right to correct such errors and cancel or modify affected orders, in accordance with the provisions of article 33, no. 2, paragraphs a) and b) of Decree-Law no. 7/2004, of January 7. In such situations, the customer will be contacted immediately with an appropriate solution, which may include reviewing the order price or canceling it, with proper justification and full refund, if applicable.
C. Availability
i. Stock Management – The Ludimusic Site strives to keep updated information regarding the availability and stock of products. If a product becomes unavailable after the order is placed, the Ludimusic Site will contact the customer to inform them of the situation and discuss possible solutions, such as product replacement, refund, or waiting for restocking.
ii. Shipping – Ludimusic only ships on business days. Therefore, weekends and holidays are not counted for order delivery estimates. Delivery estimate dates are merely indicative.
D. Discounts and Promotions
The Ludimusic Site periodically offers discounts and promotions, aiming to provide customers with a more attractive shopping experience. These offers are subject to the following conditions:
i. Eligibility – Discounts and promotions are available to all customers who meet the specific requirements of each offer, such as a minimum purchase, the purchase of selected products, or the use of a valid promotional code.
ii. End Date – Promotions and discounts have clearly indicated start and end dates and are only valid during that period. After the end date, the offer will no longer be applicable, and prices will return to normal values.
iii. Availability – The promotions and discounts presented on the Ludimusic Site apply exclusively to products in stock during the promotional campaign period. If a promotional product runs out of stock during the offer period, the discount will no longer apply once the stock is depleted. Ludimusic does not guarantee the maintenance of the promotional price in future restocks of the same item, unless expressly stated otherwise.
iv. Usage Restrictions – Some offers may be subject to usage restrictions, such as limiting one discount per customer, applying only to specific products, or incompatibility with other promotions. These restrictions will be clearly communicated to customers.
v. Promotion Limits – The Ludimusic Site reserves the right to limit the number of promotions available or the quantity of products that can be purchased at a discount. These limits may be applied to ensure all customers have the opportunity to benefit from the offers.
vi. Cancellation – The Ludimusic Site reserves the right to cancel or modify a promotion or discount at any time, without prior notice, especially in cases of error or abuse. If a promotion is canceled, the Ludimusic Site will inform the affected customers and seek appropriate solutions, such as applying an alternative offer or refunding the amount corresponding to the discount.
E. Pre-Orders
The Ludimusic Site offers the option to pre-order products that have not yet been released or are temporarily out of stock. By placing a pre-order, customers guarantee the reservation of the product as soon as it becomes available. The following conditions apply to pre-orders:
i. Payment – When placing a pre-order, the customer agrees to pay a deposit of at least 25% of the product's value to guarantee the reservation. The Ludimusic Site will clearly inform the payment terms and any additional fees that may apply.
ii. Availability and Release Dates – The release dates and availability of pre-ordered products are provided based on information received from manufacturers or distributors. These dates may be subject to change, and the Ludimusic Site will inform customers of any modifications as soon as it becomes aware of them.
iii. Order Processing – The Ludimusic Site is committed to fulfilling pre-orders as soon as the products become available. Orders will be processed and shipped according to the order in which they were received, considering product availability and delivery times.
iv. Cancellation and Refund – Customers have the right to cancel a pre-order at any time before the product is shipped; however, the deposit paid to guarantee the reservation of the product will not be refunded.
A. Order Processing
The processing of orders
on the Ludimusic Site follows a well-structured procedure, ensuring an efficient and satisfactory shopping experience. The main points addressed in this process include:
i. Order Confirmation – After placing an order, the customer will receive a confirmation by email, detailing the products and services purchased, the total price, and the shipping information. This confirmation serves as proof of the order and as a reference for any future communication related to the order.
ii. Order Status Updates – Customers will be informed by email about updates on the status of the order, such as preparation for shipping, actual shipping, and delivery. The Ludimusic Site may also provide a tracking service, allowing customers to follow the delivery progress.
iii. Processing Time – The processing time for orders varies according to product availability and demand. The Ludimusic Site will make efforts to process and ship orders as quickly as possible, usually within a timeframe established and communicated to customers at the time of purchase.
iv. Order Changes – If customers wish to make changes to the order, such as adding or removing items, they should contact the Ludimusic Site as soon as possible. Changes can only be made before the invoice is issued and the respective shipment. After shipping, customers must follow the applicable return and exchange policies.
B. Payment Methods
The Ludimusic Site offers several payment options to facilitate the customer's shopping experience. These options are subject to the following conditions:
i. Accepted Payment Methods – The Ludimusic Site accepts various payment methods, including credit and debit cards such as Visa and Mastercard, as well as electronic payment systems such as PayPal and MB WAY, among others. The available payment methods are constantly changing and will be presented during the purchase process.
ii. Payment Processing – Payments will be processed as soon as the order is confirmed. The Ludimusic Site reserves the right to verify the validity of credit and debit cards and the availability of funds before accepting the order. If payment is not authorized, the order will not be processed.
iii. Payment Security – The Ludimusic Site adopts strict measures to ensure the security of customers' payment information. All transactions are carried out through secure and encrypted connections, and card data is not stored by the site. In addition, the platform uses verification and authentication systems such as 3D Secure to protect customers against fraud.
iv. Rejected Payments – If a payment is rejected or presents errors, the customer will be informed and should try again or use an alternative payment method. If the problem persists, the customer should contact the financial institution responsible for the card or payment method in question. The Ludimusic Site may provide assistance whenever possible, but will not be responsible for rejected payments due to reasons beyond its control.
C. Taxes and Fees
Customers should be aware that orders may be subject to additional taxes and fees, depending on the type of product, the value of the order, and the destination. The following information addresses the main aspects related to taxes and fees:
i. VAT Rates – The value of the Value Added Tax (VAT) is calculated based on the rates applicable in Portugal or in the destination country, according to current legislation. VAT will be charged at the time of purchase and will be included in the total order price. Factors such as the type of product, the destination country, and the condition of tax exemption may affect the VAT calculation.
ii. Customs Costs – For international shipments, customers are responsible for any customs costs and applicable taxes in the destination country. These costs are not included in the total order price and must be paid by customers directly to the local customs authorities. The Ludimusic Site is not responsible for possible delays or problems related to customs and advises customers to inquire about applicable regulations and fees in the destination country before placing the order.
D. Order Cancellation
Order cancellation on the Ludimusic Site is subject to certain specific conditions and deadlines. Customers should be aware of the following topics related to cancellation:
i. Cancellation Timeframe – Customers may request the cancellation of an order up to the point of item preparation. The Ludimusic Site cannot guarantee cancellation if the order is already in the shipping process.
ii. Cancellation Process – To request the cancellation of an order, customers must contact the Ludimusic Site's customer support service, providing information such as the order number and product details. The cancellation will be processed and confirmed by email.
iii. Refund of Cancelled Orders – If the order is canceled on time, the customer will receive a full refund, including the value of the products and any shipping fees. The refund will be processed using the same payment method used for the purchase and may take up to 5 business days to complete, depending on the policies of the bank or financial institution.
iv. Exceptions – There are some situations where orders cannot be canceled. This includes, but is not limited to, orders for personalized products and orders that have already been shipped. In such cases, customers must follow the Ludimusic Site's return and exchange policy after receiving the products.
A. Shipping Methods
The shipping methods available on the Ludimusic Site vary according to several factors, including the type of product, the customer’s location, and the carrier used. Here are some important details to consider:
i. Available Shipping Methods – The Ludimusic Site offers various shipping methods, including by carrier, pick-up points, and also the option of in-store pickup, at no additional cost, and applicable exclusively to Ludimusic physical stores – Leiria and Porto – or warehouse – Turquel. The shipping method can be selected by the customer during the checkout process, and the availability of each method will depend on the specific conditions of the order.
ii. Carriers – We work with several trusted carriers to ensure that our products arrive safely and on time to our customers. The carrier used for a specific order will be determined based on the delivery location and the type of product.
iii. Shipping Costs – Shipping costs, or delivery fees, are calculated based on the selected shipping method, the weight and dimensions of the product, and the delivery location. These costs will be clearly indicated during the checkout process, before order confirmation. Please note that shipping costs are added depending on the product price, except when otherwise indicated in specific promotions.
B. Delivery Timeframe
Ludimusic strives to ensure that all orders are delivered on time. Here are some important details to consider:
i. Estimated Delivery Time – The estimated delivery time will be indicated during the checkout process, before order confirmation. This timeframe is only an estimate and may vary depending on several factors, including the selected shipping method and the delivery location.
ii. Factors Affecting Delivery Time – Various factors may affect delivery time, including, but not limited to, the delivery location, product availability, carrier capacity, and adverse weather conditions. We will do our best to inform customers of any potential delays as soon as we become aware of them.
iii. Tracking Information – Once the order is shipped, we will provide the customer with a tracking code that can be used to monitor the delivery progress. Tracking updates are provided by the carrier and may not be available immediately after shipment.
iv. Delays – Despite our best efforts, delays may sometimes occur due to factors beyond our control. If your order is delayed, please contact our customer support service for assistance. We will do our best to resolve the situation and ensure your order is delivered as quickly as possible.
C. International Shipping
Ludimusic is pleased to offer international shipping to a variety of destinations worldwide. Here are some important details to consider:
i. Available Countries – We offer shipping to several countries outside Portugal. The customer can choose the delivery country when accessing the site and during the checkout process, from a list of available options. If your country is not listed, unfortunately, we do not currently offer shipping to that location.
ii. Shipping Costs and Delivery Times – Shipping costs and delivery times for international shipments vary depending on the destination and the selected products. This information will be provided during the checkout process, before order confirmation. It is not always possible to calculate an estimated delivery time.
iii. Customs Costs – Please note that, for international shipments, customers are responsible for any customs costs that may apply in the destination country. These costs are not included in the shipping costs and are not controlled by Ludimusic. We recommend checking with the local customs authority for more information about possible fees before placing your order.
iv. Customs Clearance – Customers are responsible for ensuring that the ordered products comply with the import regulations of the destination country. In some cases, it may be necessary to provide additional information for customs clearance. If you have any doubts or concerns about this process, we recommend checking with your local customs office before placing your order.
If the customer refuses or fails to complete the customs clearance process, the order may, after a certain period (which varies depending on the destination country), be considered abandoned by the customs authorities. In such cases, Ludimusic is not responsible for any incurred costs, including shipping fees, customs duties, import taxes, or administrative charges. No refund will be issued, including for the amount paid for the product, unless otherwise agreed in advance. It is the customer's responsibility to be aware of the applicable deadlines in their country to avoid losing the order.
If the customer wishes to return a product, and it is not covered by the warranty, the return shipping costs and any additional charges, such as customs fees, will be the customer’s responsibility, and no refund will be issued. However, if the product is covered by the warranty, Ludimusic may cover these costs, ensuring a simpler and worry-free process for the customer.
D. Shipping Restrictions
There are some restrictions that may affect our ability to deliver certain products to specific destinations. Here are some important details to consider:
i. Restricted Products – Due to safety and import regulations, certain products may not be available for shipping to all locations. Additional information about any product restrictions will be provided on the product page.
ii. Size and Weight Limitations – The weight and dimensions of a package may affect its eligibility for delivery to certain destinations or through certain shipping methods. If a product exceeds the weight or dimension limits, this will be indicated during the checkout process.
iii. Geographical Restrictions – Some areas may have shipping restrictions due to local regulations or logistical difficulties. If there are shipping restrictions for your delivery location, this will be indicated during the checkout process.
iv. Carrier Restrictions – Carriers may have their own shipping restrictions, which may affect our ability to deliver certain products to specific destinations. Whenever possible, we will work with our carriers to minimize these restrictions, but in some cases, it may not be possible to ship certain products to your location.
E. Liability Limitations
Ludimusic is not liable for delays or failures caused by third parties (such as carriers or postal services). In cases of force majeure (such as natural disasters, strikes, conflicts, technical failures) that prevent the normal execution of the contract, Ludimusic is not considered responsible for delays or non-fulfillment. The legal three-year warranty remains valid in all cases of product non-conformity.
A. Return Policy
i. Return period (30 days) – We strive to ensure that our customers are always satisfied with their purchases. If, for any reason, you are not completely satisfied with the product you purchased, you have, by law, a period of 14 consecutive days after receiving the product to exercise your right of free withdrawal, in accordance with article 10 of Decree-Law no. 24/2014 of February 14. However, Ludimusic offers, on its own initiative, an extended return period of 30 days, also counted from the date of receipt.
ii. Eligible items – Items that can be returned are subject to our return policy. Products such as software, digital items, perishable goods and consumables, such as strings, drumsticks, drum heads, cables, picks, batteries, valves, crossfaders, and books, or those that, for hygienic reasons, cannot be returned (e.g., harmonicas), are not eligible for return. For certain products whose supply depends on a specific order from the manufacturer or supplier (i.e., products not held in regular stock), the customer acknowledges and agrees that the 14-day right of free withdrawal does not apply, under the terms of article 17, paragraph c) of Decree-Law no. 24/2014. In such cases, Ludimusic reserves the right to retain the deposit paid in the event of cancellation of the order by the customer, as compensation for the costs assumed with the order to the supplier.
iii. Return conditions – To be eligible for a return, the item must be in its original condition, with no signs of use or damage, and must include the original packaging, all accessories and the documentation provided.
iv. Return authorization – Customers must obtain a return authorization before sending the products back. To initiate a return, you must contact our customer support and provide the order number and details about the product you wish to return. The team will promptly respond with instructions on how to proceed with your return. Please note that you may be responsible for the cost of return shipping, unless the return is due to an error on our part (received an incorrect or defective item). Ludimusic reserves the right to refuse or limit the acceptance of returns when there are clear signs of abusive use of the right of return; in such case, Ludimusic may refuse the return or refund, previously communicating to the customer the grounds for the decision, in accordance with the principle of good faith (art. 762 of the Civil Code) and with the applicable consumer protection legislation. This measure aims to protect the integrity of the service and ensure a fair return policy for all customers.
v. Warranties – All purchases made at Ludimusic are covered by a 3-year manufacturer warranty. Due to the need for maintenance of the products mentioned in point ii. (chapter 6), signs of wear will only be covered if they result from a clear manufacturing defect. During this period, customers acting in good faith may request repair, replacement or reimbursement of the amount paid for the product. If a product shows a manufacturing defect or does not meet the stated specifications, Ludimusic assumes responsibility for the conformity and will provide the appropriate solution at no cost to the customer. If the situation falls within and is accepted under the warranty, it will not be subject to the return conditions set out in point iii. (chapter 6).
B. Refund
i. Refund method – Once we receive your return, we will inspect the item and notify you of the status of your refund. If the return is approved, we will initiate a refund preferably by the same payment method used in the purchase. If there is any technical impossibility or restriction, Ludimusic reserves the right to use an alternative method, according to the customer’s choice and the viability of the method.
ii. Refund amount – The amount to be refunded will be the total amount paid by the customer for the returned product, including applicable taxes, discounts and shipping fees, if applicable. Please note that shipping costs are not subject to refund, except if the return is due to an error on our part.
iii. Refund processing time – Depending on the policies of your card issuer, the refund may take up to 5 business days to be reflected in your account.
C. Exchanges
We understand that sometimes you may change your mind or want a different product. If you wish to exchange the item you purchased for another one, contact our customer support team within 30 days after receiving the order.
i. Eligibility for exchange – For items to be eligible for exchange, they must be in original condition, with no signs of use or damage, and must include the original packaging, all accessories, and the documentation provided.
ii. Inventory availability – Exchanges are subject to inventory availability. If the product requested for exchange is not in stock, we may offer alternatives or a refund.
iii. Shipping costs – Shipping costs for exchanges may be the responsibility of the customer or Ludimusic, depending on the specific circumstances of the exchange. This information will be provided during the exchange process.
iv. Replacement items and price adjustments – Once we receive the returned item, we will send the replacement item. If there is a price difference between the returned item and the replacement item, the user may have to pay the difference or, if the replacement item is of lower value, the user will receive a partial refund, except for payments made with credits.
D. Damaged or Defective Products
i. Reporting process – In the unfortunate event that you receive a damaged or defective item, we sincerely apologize and guarantee that we will resolve the issue quickly. Customers have a period of 5 days from the date of receipt to report the problem by contacting our customer support.
ii. Proof of damage or defect – To resolve issues with damaged or defective products, customers must provide evidence such as photographs, videos and a detailed description of the damage or defect, so we can properly assess the situation.
iii. Resolution options – After verifying the issue, we will proceed with a full refund or replacement of the damaged or defective item, according to your preference and stock availability.
iv. Shipping Costs – In such cases, we will also refund any shipping costs associated with the return of the item. Our goal is to ensure your complete satisfaction with your purchase and to maintain your trust in our service.
A. Copyright and Trademark
All content present on the Ludimusic Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of our e-commerce store or its content providers and is protected by international copyright laws. The entirety of this content is the exclusive property of our store and is protected by international copyright laws.
The trademarks, names, and logos of Ludimusic and respective product brands presented on the Ludimusic Site are registered trademarks. Nothing contained on the Ludimusic Site shall be interpreted as granting any license or right to use any registered trademark without prior written authorization. Unauthorized use of these trademarks will be considered a violation of our rights and those of our suppliers and may have legal consequences.
B. License and Access to the Site
We grant you a limited license to access and make personal use of our site. Downloading any of the site's pages (except for "cache" situations) or modifying, or any part of it, is not permitted, except with our express written consent. The user grants us the non-exclusive, royalty-free, perpetual, irrevocable right to the content they post, and the Ludimusic trademark holds the right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content worldwide and in any media. The user grants us the right to use the name submitted in connection with that content.
